[judicial recall] Call-In (09.28.2006) Constitutional Initiative 98
seeks to amend the Montana Constitution to make it easier to recall state
court justices or judges by saying they can be recalled for any reason.
Montana
statues currently allow for the recall of public officials, including
state court justices or judges. CI-98 proponent and Republican state Representative
Ed Butcher of Winifred and opponent and former Montana
Supreme Court Justice Jim Regnier discuss CI-98 during
this call-in program moderated by YPR News Director Jackie Yamanaka
and Jim Gransbery of the Billings
Gazette. A state District Judge recently de-certified the signatures
collected for this and two other ballot measures citing that the paid,
out-of-state signature gatherers engaged in a "general pattern and
practice of fraud and procedural non-compliance." Proponents have
appealed to the Montana Supreme Court.
